DSI Work Solutions provides professional training, certification programs, consulting services, and the Job Function Matching System to help employers and healthcare providers improve workplace safety, reduce injury-related costs, and ensure compliance with workplace regulations.

1. License to Use Our Services

Subject to these Terms, DSI Work Solutions grants you a limited, personal, non-exclusive, non-transferable license to access and use the Platform for your professional development and business purposes. This license is conditioned upon your compliance with these Terms and the payment of any applicable fees for courses, certifications, or subscriptions. The scope of your access depends on your purchased courses and assigned user role.

DSI Work Solutions operates both this website and Saffie (saffie.app), a Software-as-a-Service platform for job function matching. Your account credentials work across both platforms.

• Courses marked as available on both platforms can be accessed from either site
• Your training progress syncs between platforms for shared courses
• Each platform maintains separate user profiles and platform-specific data
• Terms for Saffie usage are governed by Saffie's separate Terms of Service

Companies may purchase training access for their employees. Under enterprise arrangements:

• Company administrators may assign courses to employees
• Training progress and completion data may be visible to company administrators
• Employees access training through their individual accounts
• Companies are responsible for ensuring employee compliance with these Terms
• Enterprise agreements may include additional terms and conditions

7. Pricing and Payment

Pricing: Course prices are displayed at the time of purchase and may change without notice. Promotional pricing is subject to specific terms and availability.

Payment: Payment is required at the time of purchase. We accept major credit cards and other payment methods as displayed during checkout. You agree to pay all applicable fees and taxes.

Subscriptions: If you purchase a subscription, it will auto-renew unless canceled before the renewal date. You may cancel subscriptions through your account settings.

8. Refund Policy

Digital Products: Due to the nature of digital training content, refunds are generally not available once course access has been granted.

Exceptions: Refunds may be considered in cases of:

• Technical issues preventing course access that cannot be resolved
• Duplicate purchases
• Billing errors

Refund requests should be submitted to contact@dsiworksolutions.com within 14 days of purchase.

9. Job Function Matching System

DSI Work Solutions provides training and certification in the Job Function Matching System, a methodology for standardizing job function descriptions and physical demands assessments. Users who complete certification training are authorized to apply the methodology in their professional practice.

The Job Function Matching System software is available through Saffie and is subject to Saffie's Terms of Service. Training on this website prepares you to use the Saffie software effectively.

10. Prohibited Uses

You agree not to:

• Share, resell, or redistribute course content or access
• Use automated tools or bots to access the Platform
• Attempt to circumvent security measures or access restrictions
• Use the Platform for illegal purposes
• Upload malicious code or content
• Create multiple accounts to abuse free trials or promotions
• Misrepresent your identity or qualifications
• Falsify certificate or completion records

11. User Responsibility

You are solely responsible for how you apply the knowledge and skills gained from DSI Work Solutions training in your professional practice. DSI Work Solutions provides education and training but does not supervise or control your professional activities. You must operate within your professional scope of practice and applicable regulations.

DSI Work Solutions is not responsible for any decisions, actions, or outcomes resulting from your application of training content. Always consult with qualified professionals and legal counsel as appropriate for your specific situations.

We comply with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, contact contact@dsiworksolutions.com with:

• Identification of the copyrighted work
• Description of the infringing material and its location
• Your contact information
• A good-faith statement of infringement and accuracy under penalty of perjury

13. Internet Connection

You are responsible for obtaining and maintaining the equipment and internet access required to use the Platform. Some course content may require specific bandwidth for video playback.

14. Changes to the Service

DSI Work Solutions may modify, update, or discontinue courses, features, or services at any time. We will make reasonable efforts to notify you of significant changes that affect your purchased content. Course content may be updated to reflect current best practices and methodologies.

15. Termination

We may suspend or terminate your access to the Platform at our discretion for violations of these Terms or other misconduct. Upon termination:

• Your access to courses and Platform features will cease
• Certificates already issued remain valid and verifiable
• Training records are retained for verification purposes
• No refunds are provided for termination due to Terms violations

16. Disclaimer of Warranties

The Platform and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or meet your specific requirements.

Training content is educational in nature and should not be considered professional advice. Always consult with qualified professionals for specific workplace situations.

17. Limitation of Liability

To the fullest extent permitted by law, DSI Work Solutions, its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; (c) any content obtained from the Platform; or (d) your application of knowledge or skills gained from training content.

Our total liability for any claims under these Terms shall not exceed the amount you paid to DSI Work Solutions in the twelve months preceding the claim.

18. Indemnification

You agree to indemnify and hold harmless DSI Work Solutions, its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your application of training content in professional practice; or (d) your violation of any third-party rights.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles.

20. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Kentucky, USA. You waive any right to participate in a class action lawsuit or class-wide arbitration.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on the Platform and/or via email. Your continued use of the Platform after such notification constitutes your acceptance of the updated Terms.

22. Miscellaneous

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and DSI Work Solutions regarding the Platform.

Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Failure to enforce any right or provision does not constitute a waiver.

Assignment: You may not assign these Terms without our written consent. We may assign our rights and obligations under these Terms.
